Summary:
  • Father Augustine M. Giella was accused of sexually abusing a male minor child on at least five occasions from approximately 1984 when the male child was approximately eleven years old until approximately 1986 when the male child was approximately thirteen years old. At the time of the sexual abuse, Father Giella was assigned to St. John the Evangelist Church in Enhaut, Pennsylvania, and the male child attended religious services at the church. The sexual abuse took place inside the rectory of St. John the Evangelist’s Church and inside St. John the Evangelist Church.
  • The sexual abuse by Father Giella included the following: Father Giella fondled the boy’s buttocks skin on skin; Father Giella exposed his penis to the boy; Father Giella had the boy expose the boy’s penis to Father Giella; Father Giella fondled the boy’s penis skin on skin; and Father Giella made the boy fondle Father Giella’s penis, skin on skin.
  • The claim settled in July 2023 in the low-to-mid six figures.

  • Father Ginty was accused of sexually abusing a female minor child on one occasion in approximately 1968 when the girl was approximately 10 years old. At the time of the sexual abuse, Father Ginty was assigned to Church of the Nativity in El Monte, California, and the girl was attending CCD classes through Church of the Nativity.

  • The sexual abuse by Bishop Gutierrez included the following: Bishop Gutierrez fondling the boy’s genitals skin on skin, and sometimes Bishop Gutierrez fondling himself while he fondled the boy’s genitals.
  • The Diocese of Brooklyn agreed to settle the claim in the low to mid six figures 2021.
  • Bishop Gutierrez died in February 2019.
